The passing of a loved one is the most difficult thing that we will ever have to endure. There is a responsibility on the appointed person / persons (Executor) to administer the deceased person’s estate and to obtain a Grant of Probate.
The first person you are advised to discuss this with is the solicitor for the estate. This is a legal process which gives the person or persons the authority to the deal with the deceased person’s estate and the Probate works by making an application to the Probate Office and the District Probate Register. The legal process involves getting a document called a Grant of Representation from the Probate Office.
The aim is to ultimately protect the beneficiaries otherwise there would be no accountability and the various institutions involved would not know who to release the deceased’s assets to. It also allows the courts to check that the will is valid and that the deceased’s estate is administered by the correct person.
You are advised to obtain a detailed valuation in relation to all of the assets of the deceased person. You, as executor, have the decision to appoint an auctioneer to sell the properties and to get the best price for the asset.
It is advisable to have the Probate taken out prior to placing the properties on the market.
